    What regulates the law on the main pipeline transport of oil

    The law "On the main pipeline transport of oil and oil products" was prepared on behalf of Vladimir Putin on July 30, 2015 by the Ministry of Energy and was supposed to be submitted to the government by June 1, and to the State Duma by October 1, follows from the government's legislative activity plan. The bill stipulates the conditions for access to the pipeline for its maintenance and repair, to eliminate the consequences of accidents, regulates land problems that arise during the laying and maintenance of pipelines, as well as tariffs for pumping oil, relations with oil suppliers to the pipeline system.

    Rosneft's remarks

    The main remarks to the law were made by Rosneft. On April 24, Rosneft Chief Executive Officer Igor Sechin sent Energy Minister Alexander Novak the company's comments on the bill - 25 sheets (RBC has a copy). The head of Rosneft does not agree with the “investment” tariff surcharges introduced by the bill, points to the “opaque structure” of the redistribution of profits within the Transneft group, and also does not agree with the “pump or pay” principle enshrined in law.

    Subsequently, Rosneft's comments on the bill were expanded. A letter from Vice President for Trading Otabek Karimov dated June 9 to Deputy Energy Minister Kirill Molodtsov (attachment on 39 pages; available from RBC) emphasizes that the draft law contains abuses of Transneft's dominant position, violates property standards and threatens the safety of pipelines, as does not apply to pipeline projects of oil companies, etc.

    The representative of the Ministry of Energy declined to comment on this correspondence, saying only that the department continues to work on the bill.

    Rosneft spokesman Mikhail Leontyev also declined to comment on Sechin's correspondence with the Ministry of Energy and the company's comments on the bill. The representative of Rosneft specified that the company does not own the main pipelines.

    Adviser to the president of Transneft, Igor Demin, told RBC: “To adopt the bill is an instruction from the president given two years ago. They [Rosneft] sent comments a year and a half after the start of work on the bill and six months after the start of the procedure for its public discussion.” Rosneft's position, in his opinion, pursues the only goal - to achieve an upgrade in the status of part of its oil pipelines to "trunk", which gives the right to receive benefits provided by the Tax Code. “They want benefits without government regulation of tariffs for their oil pipelines and without the ability to connect other users to them,” he says.

    RBC's source in Rosneft considers these claims strange. According to him, the head of state instructed to ensure the safety of oil transportation through pipelines, and not to create preferences for the oil transport monopoly. The interlocutor called the investment tariffs and fines of Transneft, including the “pump or pay” scheme, “collection of tribute”. “If you invest in an asset, then at least you should receive a share in this asset,” he explained.

    RBC got acquainted with the comments on the bill sent by RussNeft, Gazprom Neft and Tatneft, as well as a number of relevant departments. LUKOIL did not send any comments, a source in the company told RBC. Surgutneftegaz sent it on May 25, but withdrew it on May 30 after discussions with the Ministry of Energy and Transneft.

    According to one of the participants in the meeting on June 14, the FAS also did not send any comments. The Antimonopoly Service does not see the advisability of adopting this law, since the current legislation regulates all the issues raised by it, an official representative of the department told RBC.

    Tatneft proposes to ban Transneft, as the owner of trunk pipelines, from trading in oil and oil products, to increase the time for negotiating oil pumping contracts with companies from 15 to 30 days, and to prohibit refusing to oilmen the right to pump oil through pipes due to its non-compliance with quality standards. Gazprom Neft is asking to allow producing companies to own trunk pipelines and to give them the opportunity to challenge in court the size of Transneft's fines for oil not delivered to the system on time.

    The Ministry of Finance believes that the bill leads to a reduction in federal budget revenues due to a wider list of cases of issuing permits for water use without holding auctions, but is ready to agree on the text if its comment is taken into account. The Ministry of Economic Development believes that some of the norms prescribed in the law are redundant, since they are already regulated by the government, including tariffs for pumping oil. According to RBC's source in this department, some of the comments were taken into account following the results of past meetings.

    Representatives of Surgutneftegaz, RussNeft, the Ministry of Finance, Gazprom Neft and the Ministry of Economic Development declined to comment. Tatneft did not respond to the request.

    Position of Transneft

    Penalties in case of underloading of pipelines on time and the principle of "pump or pay" are necessary to maintain discipline among oil companies, Igor Demin explained to RBC. “We adjust the amount of oil delivered to the Transneft system in three stages: annually, quarterly and monthly. And the oilmen disrupt the volume of supplies. A fine of 10 minimum wages per ton of oil is proposed to be provided only if the suppliers have not warned Transneft about the change in the volume of oil pumped at least a month in advance. After all, we bear the cost of maintaining the operation of the system and must plan our activities in advance,” says the adviser to the head of Transneft.

    The use of agreed investment tariffs, according to him, is the most popular way for oil companies to finance new capacities. “There are other forms of financing: for example, to build entirely at the expense of oil companies or entirely at the expense of Transneft. Companies themselves choose what is more profitable for them, ”he clarifies.

    The comments of other market participants and departments to the document, the representative of Transneft called working and negotiable, adding that some of them have already been removed from the agenda.

    The project to create an Amur oil refinery is contrary to the interests of the state, adviser to the president of the Transneft Corporation, Igor Demin, believes. We are not interested in having one monopoly recipient of all oil - we want it to remain on the market, to be bought at market prices.
